Explanation using Example
Imagine a factory owner, Mr. Sharma, who has been directed by the State Pollution Control Board to install a wastewater treatment plant to prevent the discharge of untreated effluent into a nearby river. Despite receiving this order, Mr. Sharma fails to comply within the stipulated time frame. This non-compliance is a contravention of the Water (Prevention and Control of Pollution) Act, 1974, as he has not followed the direction given by the authority.
Under Section 45A of the Act, because there is no specific penalty mentioned elsewhere in the Act for this particular type of non-compliance, Mr. Sharma is now subject to legal action. He could face a punishment that includes imprisonment for up to three months, a fine up to ten thousand rupees, or both. Moreover, if he continues to ignore the order after his initial conviction, he could incur an additional fine of up to five thousand rupees for every day the contravention persists.
