Explanation using Example
Imagine a group of factory workers in the city of Jammu decide to form a trade union to negotiate better wages and working conditions. They follow the necessary procedures and submit their application for registration to the Registrar. After reviewing the application and ensuring it meets all the requirements of The Trade Unions Act, 1926, the Registrar registers the union.
In accordance with the Jammu and Kashmir (UT) amendment to Section 9, the Registrar must issue a certificate of registration to this newly formed trade union within 30 days of registration. This certificate serves as conclusive evidence that the trade union is now officially registered under the Act. With this certificate, the trade union can legally represent the workers and engage in collective bargaining with the factory management.
