Imagine John, a journalist, is investigating a case where he suspects corruption in the procurement of equipment by a government intelligence agency, which is listed under the Second Schedule of the Right to Information Act, 2005. He files an RTI request seeking details about the procurement process and the contracts awarded.
Under Section 24(1) of the RTI Act, the intelligence agency is generally exempt from the RTI Act's disclosures. However, since John's request pertains to allegations of corruption, the agency is obligated to provide the information requested, subject to the approval of the Central Information Commission, and must do so within forty-five days as per the Act's provisions.
If the agency refuses to disclose the information, John has the right to appeal to the Central Information Commission, invoking the exception provided for allegations of corruption under Section 24.
