Explanation using Example
Imagine a prisoner named John who has repeatedly caused disturbances in the prison by getting into fights with other inmates. Despite several warnings and minor punishments, John continues to disrupt the prison order. The Superintendent of the prison determines that the usual disciplinary measures are not sufficient to address John's behavior.
Utilizing Section 52 of The Prisons Act, 1894, the Superintendent decides to escalate the matter. John is sent to the local District Magistrate's court with a detailed report of his repeated offences. The Magistrate conducts a trial and finds John guilty of the charges. Given the severity and frequency of John's misconduct, the Magistrate sentences him to an additional six months of imprisonment, on top of his current sentence.
However, the Magistrate ensures that John is not punished twice for the same infraction, in accordance with the provisions of Section 52, which safeguards against double jeopardy.
