Explanation using Example

Imagine a manufacturing company that has been penalized by the National Green Tribunal (NGT) for causing pollution in a nearby river. The company believes that the decision made by the NGT is unjust as they have evidence that they were not the source of the pollution. As the company is aggrieved by the NGT's order, it decides to appeal to the Supreme Court. According to Section 22 of The National Green Tribunal Act, 2010, the company must file its appeal within ninety days from the date the NGT's decision was communicated to them.

However, if the company fails to file the appeal within ninety days due to a legitimate reason, such as a natural disaster that disrupted their operations, the Supreme Court has the discretion to allow the appeal after the ninety-day period, upon being convinced that there was a sufficient cause for the delay.
