Explanation using Example

Imagine a resident named Meena who lives in an unauthorized colony in Delhi. She has been residing there for many years and has a notarized Agreement to Sale and a possession letter for her home, but these documents are not formally recognized due to the unauthorized status of the colony. With the enactment of The National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Act, 2019, Meena sees a government notification that allows her to regularize the transaction of her property.

Following the procedure, Meena pays the fixed charges as notified by the government. She submits her Agreement to Sale and possession letter along with the payment of consideration as evidence. Consequently, she receives a conveyance deed that officially recognizes her right of ownership.

Furthermore, the stamp duty and registration charges for this conveyance deed are calculated based on the amount mentioned in it, making the process more affordable for Meena. Additionally, she does not have to pay any stamp duty and registration charges for the previous notarized Agreement to Sale that she had before the regularization process.

It's important to note that if Meena were merely a tenant or licensee, she would not be eligible for property rights under this Act, as it specifically excludes tenants, licensees, and permissive users from being recognized as property owners in unauthorized colonies.
