Explanation using Example
Imagine a situation where a tenant, John, has a lease agreement with his landlord, Mary, that strictly prohibits subletting the property. However, John starts subletting a room to his friend, Alex, without Mary's consent, thus breaching the contract. This is a continuing breach as long as Alex stays in the room without Mary's permission. According to Section 22 of The Limitation Act, 1963, Mary can take legal action against John for breach of contract at any point during the ongoing unauthorized subletting. Each day that Alex continues to stay constitutes a new breach, and the limitation period for Mary to file a lawsuit resets with each passing day of the continuing violation.
