Imagine a scenario where the Legislative Council of Jammu and Kashmir is in session, and a bill regarding environmental protection is being discussed. This bill has passed the Legislative Assembly and is now pending in the Legislative Council. However, the Jammu and Kashmir Reorganisation Act, 2019 comes into effect, and as per Section 57(1), the Council is abolished on the appointed day.
As a result, according to Section 57(2), all the members of the Legislative Council immediately lose their membership. They no longer have the authority to participate in legislative processes or hold their titles as members of the Council.
Consequently, the environmental protection bill that was under consideration in the Council automatically lapses because of Section 57(3). The bill would need to be reintroduced in the newly formed legislative body if it is to be considered again for enactment.
