Explanation using Example
Imagine a company XYZ Pvt. Ltd. had to retrench 50 workers due to economic difficulties. After six months, the company's financial situation improved, and they needed to hire 30 new workers for the same roles that were retrenched. According to Section 25H of The Industrial Disputes Act, 1947, XYZ Pvt. Ltd. must notify the 50 retrenched workers, who are citizens of India, and give them the opportunity to apply for these positions before considering other candidates. If the retrenched workers apply for re-employment, they must be given preference over new applicants, assuming they still possess the necessary skills for the job.
