Explanation using Example
Example 1:
Ravi is a married man living in Mumbai. He discovers that his wife, Priya, is having an affair with their neighbor, Arjun. Ravi did not consent to this relationship and was unaware of it until he found evidence. Under Section 497 of the Indian Penal Code, Arjun can be charged with adultery because he had sexual intercourse with Priya, knowing she is Ravi's wife and without Ravi's consent. Arjun could face imprisonment for up to five years, a fine, or both. Priya, however, will not be punishable under this section.
Example 2:
Sunil, a businessman in Delhi, finds out that his wife, Anjali, is involved in a romantic relationship with her colleague, Rajesh. Sunil did not approve of this relationship and was completely unaware of it. Rajesh, knowing that Anjali is married to Sunil, continued the affair. According to Section 497 of the Indian Penal Code, Rajesh can be prosecuted for adultery because he engaged in sexual intercourse with Anjali, who is married to Sunil, without Sunil's consent. Rajesh could be sentenced to imprisonment for up to five years, fined, or both. Anjali will not face any punishment under this section.
