Explanation using Example

Example 1:

Ravi and Priya are legally married. However, Ravi falls in love with another woman, Anjali, and decides to marry her without divorcing Priya. According to Section 494 of the Indian Penal Code, Ravi is committing the offense of bigamy because he is marrying Anjali while still being legally married to Priya. If found guilty, Ravi could face imprisonment for up to seven years and may also be liable to pay a fine.

Example 2:

Sunita's husband, Rajesh, went missing seven years ago, and she has not heard from him since. Believing that Rajesh is no longer alive, Sunita decides to marry another man, Amit. Before marrying Amit, Sunita informs him about Rajesh's disappearance and the fact that she has not heard from him for seven years. According to the exception in Section 494, Sunita is not committing an offense because she has not heard from Rajesh for seven years and has informed Amit about the situation before their marriage. Therefore, Sunita's marriage to Amit is legally valid under this section.
