Example 1:
Ravi runs a small workshop where he manufactures metal parts. He decides to create a die that replicates the trademark of a well-known brand of automobile parts. Ravi plans to use this die to stamp the counterfeit trademark on his own products to make them appear as if they are from the reputed brand. If caught, Ravi can be charged under Section 485 of the Indian Penal Code for making an instrument for counterfeiting a property mark. He could face imprisonment for up to three years, a fine, or both.
Example 2:
Sita owns a small shop that sells various household items. She comes across a set of counterfeit labels that bear the property mark of a famous electronics company. Sita decides to purchase these labels and use them to mark her generic electronic products, making them appear as if they are from the well-known company. If authorities discover these counterfeit labels in her possession, Sita can be prosecuted under Section 485 of the Indian Penal Code for possessing a property mark for the purpose of denoting that goods belong to a person to whom they do not belong. She could be sentenced to imprisonment for up to three years, fined, or both.
