Explanation using Example
Example 1:
Ravi owns a piece of land in Maharashtra. He decides to sell this land to Suresh. However, Ravi and Suresh agree to falsely state in the sale deed that the land is being sold for ₹10 lakh, while the actual consideration is ₹5 lakh. This false statement is made to evade higher stamp duty and taxes. Ravi and Suresh sign and execute the deed with this false consideration amount. Under Section 423 of the Indian Penal Code, both Ravi and Suresh can be punished for dishonestly executing a deed of transfer containing a false statement of consideration.
Example 2:
Meena wants to transfer her house in Delhi to her brother, Rajesh. However, to avoid family disputes, they decide to create a deed that falsely states that the house is being transferred to a third party, Anil, for ₹20 lakh. In reality, Anil is just a front, and the house is intended for Rajesh's benefit. Meena and Rajesh sign and execute the deed with this false statement about the beneficiary. Under Section 423 of the Indian Penal Code, Meena and Rajesh can be punished for fraudulently executing a deed of transfer containing a false statement about the person for whose benefit the transfer is intended.
