Explanation using Example

Example 1:

Ravi and Priya have been living separately for six months due to marital issues. They have not yet filed for a formal decree of separation but are living in different houses. One evening, Ravi visits Priya's house to discuss their relationship. During the visit, Ravi forces himself on Priya and has sexual intercourse with her without her consent. Under Section 376B of the Indian Penal Code, Ravi can be charged with sexual intercourse by a husband upon his wife during separation, and if found guilty, he could face imprisonment for a term between two to seven years and may also be liable to pay a fine.

Example 2:

Sunil and Anjali have been granted a judicial separation by the court, and they are living apart as per the decree. One day, Sunil goes to Anjali's residence to collect some of his belongings. During his visit, Sunil coerces Anjali into having sexual intercourse with him against her will. Despite being legally married, Sunil's actions constitute an offense under Section 376B of the Indian Penal Code because Anjali did not consent to the act, and they were living separately under a decree of separation. Sunil could be sentenced to imprisonment for a period ranging from two to seven years and may also be fined.
