Explanation using Example
Example 1:
Ravi and Priya are colleagues. One evening, after a work party, Ravi offers to drop Priya home. On the way, he stops the car in a secluded area and forces himself on Priya, penetrating her without her consent. Priya tries to resist but is overpowered. This act falls under Section 375(a) and is considered rape as it was done against her will.
Example 2:
Aman and Neha are in a relationship. One night, Aman convinces Neha to have sexual intercourse by threatening to harm her younger brother if she refuses. Neha, fearing for her brother's safety, consents. This situation falls under Section 375(c) as her consent was obtained by putting her in fear of hurt to her brother, making it rape.
Example 3:
Rajesh, a doctor, administers a sedative to his patient, Meera, during a routine check-up. While Meera is unconscious, Rajesh inserts an object into her vagina. Meera is unable to understand or consent to the act due to the sedative. This falls under Section 375(b) and is considered rape as it was done without her consent and she was unable to understand the nature of the act.
Example 4:
Vikram, pretending to be his twin brother, who is married to Sita, engages in sexual intercourse with her. Sita consents, believing Vikram to be her husband. This falls under Section 375(d) as her consent was given under the false belief that Vikram was her husband, making it rape.
Example 5:
A 25-year-old man, Arjun, has sexual intercourse with a 16-year-old girl, Riya, with her consent. Despite her consent, this act falls under Section 375(f) as Riya is under eighteen years of age, making it statutory rape.
Example 6:
During a medical examination, Dr. Kumar performs a necessary procedure that involves penetration of the vagina. This act does not constitute rape as per the exception provided for medical procedures.
Example 7:
Suresh, a married man, has sexual intercourse with his wife, who is 20 years old, without her consent. Although this act is non-consensual, it does not fall under the definition of rape as per the exception provided for sexual acts between a husband and wife, where the wife is not under fifteen years of age.
