Explanation using Example
Example 1:
Ravi, in a fit of rage, attacks his neighbor Priya with a heavy object, knowing that she is pregnant and that his actions could potentially cause her death. Priya survives the attack but suffers severe injuries. Unfortunately, the unborn child she was carrying, which was in the advanced stage of pregnancy (quick unborn child), dies as a result of the injuries inflicted by Ravi. In this scenario, Ravi can be charged under Section 316 of the Indian Penal Code for causing the death of the quick unborn child by an act amounting to culpable homicide.
Example 2:
Sunil, during a heated argument with his pregnant wife, Shalini, pushes her down the stairs. Sunil is aware that his actions could lead to serious harm or even death. Shalini survives the fall but sustains significant injuries. Tragically, the unborn child she was carrying, which was in the later stages of pregnancy, does not survive the incident. Sunil's actions, which could have resulted in Shalini's death, instead caused the death of the quick unborn child. Sunil can be prosecuted under Section 316 of the Indian Penal Code for his actions.
Example 3:
During a robbery, Ajay, the perpetrator, violently assaults a pregnant woman, Meera, to subdue her. Ajay is aware that his actions could potentially cause Meera's death. Meera survives the assault but suffers critical injuries. The unborn child she was carrying, which was in the advanced stage of pregnancy, dies due to the trauma inflicted. Ajay's actions, which could have led to Meera's death, instead resulted in the death of the quick unborn child. Ajay can be held accountable under Section 316 of the Indian Penal Code for causing the death of the quick unborn child by an act amounting to culpable homicide.
