Explanation using Example
Example 1:
Ravi, a 30-year-old man, sees a 15-year-old boy named Arjun playing in a park. Ravi convinces Arjun to come with him to a nearby shop to buy some toys. Ravi does this without informing or getting permission from Arjun's parents, who are his lawful guardians. In this scenario, Ravi has kidnapped Arjun from lawful guardianship because he took a minor under sixteen years of age out of the keeping of his lawful guardians without their consent.
Example 2:
Meena, a 25-year-old woman, befriends a 17-year-old girl named Priya. Meena persuades Priya to leave her home and stay with her for a few days, promising her a better life. Priya's parents, who are her lawful guardians, are unaware of this and have not given their consent. Meena has kidnapped Priya from lawful guardianship because she enticed a minor under eighteen years of age out of the keeping of her lawful guardians without their consent.
Example 3:
Ramesh, a 40-year-old man, sees a 20-year-old woman named Sita who has an unsound mind wandering near a market. Ramesh takes Sita to his home without informing or getting permission from Sita's lawful guardian, who is her elder brother. In this case, Ramesh has kidnapped Sita from lawful guardianship because he took a person of unsound mind out of the keeping of her lawful guardian without consent.
Example 4:
Anil, who believes in good faith that he is the biological father of a 5-year-old boy named Rohit, takes Rohit from his mother's house without her consent. Anil genuinely believes he has the right to Rohit's custody. Since Anil believes in good faith that he is entitled to the lawful custody of Rohit and has no immoral or unlawful purpose, his act does not fall under the definition of kidnapping from lawful guardianship as per the exception provided in the section.
