Explanation using Example

Example 1:

Dr. Mehta is a renowned heart surgeon. Ramesh, a 60-year-old man, is suffering from a severe heart condition that causes him immense pain and threatens his life. Dr. Mehta informs Ramesh that a complex surgery is necessary to alleviate his pain and potentially save his life, but there is a significant risk that Ramesh might not survive the operation. Ramesh, understanding the risks and seeking relief from his suffering, consents to the surgery. Dr. Mehta performs the surgery in good faith, aiming to benefit Ramesh. Unfortunately, Ramesh does not survive the operation. Under Section 88 of the Indian Penal Code, Dr. Mehta has committed no offence because the act was done with Ramesh's consent, in good faith, and was intended for Ramesh's benefit.

Example 2:

Anita is a professional mountaineer and guide. She organizes a high-altitude expedition to the Himalayas. Before the expedition, she explains to all participants, including Raj, the inherent risks involved, such as the possibility of severe frostbite, altitude sickness, or even death. Raj, an experienced climber, consents to participate, fully aware of the risks. During the expedition, Raj suffers from severe frostbite despite Anita's best efforts to ensure safety. Anita acted in good faith, with the intention of providing a beneficial and adventurous experience for Raj. Under Section 88 of the Indian Penal Code, Anita has committed no offence because the harm was not intended, was done with Raj's consent, and was intended for his benefit.
