Explanation using Example

Example 1:

Ravi is convicted of theft under the Indian Penal Code and is sentenced to rigorous imprisonment for five months. The court, exercising its power under Section 73, orders that Ravi be kept in solitary confinement for a period not exceeding one month. Since Ravi's imprisonment term does not exceed six months, the solitary confinement period is capped at one month.

Example 2:

Sita is found guilty of fraud and is sentenced to rigorous imprisonment for eight months. The court decides to impose solitary confinement as part of her punishment. According to Section 73, since Sita's imprisonment term exceeds six months but does not exceed one year, the court can order solitary confinement for a period not exceeding two months. Therefore, Sita may be kept in solitary confinement for up to two months during her imprisonment.

Example 3:

Arjun is convicted of a serious assault and is sentenced to rigorous imprisonment for two years. The court, under Section 73, orders that Arjun be kept in solitary confinement for a period not exceeding three months. Since Arjun's imprisonment term exceeds one year, the solitary confinement period is capped at three months.
