Explanation using Example
Example 1:
Ramesh was caught littering in a public park in Mumbai, which is an offence punishable by a fine of ₹30 under the local municipal laws. Ramesh, however, refused to pay the fine. According to Section 67 of the Indian Penal Code 1860, since the fine does not exceed ₹50, the court can impose a simple imprisonment term not exceeding two months. Therefore, Ramesh could be sentenced to up to two months of simple imprisonment for not paying the ₹30 fine.
Example 2:
Sita was found guilty of minor tax evasion, and the court imposed a fine of ₹80. Sita did not pay the fine within the stipulated time. Under Section 67 of the Indian Penal Code 1860, since the fine amount exceeds ₹50 but does not exceed ₹100, the court can impose a simple imprisonment term not exceeding four months. Hence, Sita could be sentenced to up to four months of simple imprisonment for failing to pay the ₹80 fine.
Example 3:
Rahul was convicted of a minor environmental violation, and the court imposed a fine of ₹200. Rahul failed to pay the fine. According to Section 67 of the Indian Penal Code 1860, since the fine amount exceeds ₹100, the court can impose a simple imprisonment term not exceeding six months. Therefore, Rahul could be sentenced to up to six months of simple imprisonment for not paying the ₹200 fine.
