Example 1:
Scenario: Rajesh, a 35-year-old man, is found guilty of committing a premeditated murder.
Application of the Act:
- First - Death: The court may sentence Rajesh to death as the punishment for his crime, considering the severity and premeditated nature of the murder.
- Secondly - Imprisonment for life: Alternatively, the court may decide to sentence Rajesh to life imprisonment, meaning he will spend the rest of his life in prison.
Example 2:
Scenario: Priya, a 28-year-old woman, is convicted of embezzling a large sum of money from her employer.
Application of the Act:
- Fourthly - Imprisonment, which is of two descriptions:
- (1) Rigorous, that is, with hard labour: The court may sentence Priya to rigorous imprisonment, requiring her to perform hard labor during her time in prison.
- (2) Simple: Alternatively, the court may sentence her to simple imprisonment, where she will be confined without the requirement of hard labor.
