Explanation using Example

Imagine a scenario where Ravi, a Hindu man governed by the marumakkattayam system of inheritance, passes away in 2023, leaving behind property that is part of his family's tarwad. According to Section 7(1) of the Hindu Succession Act, 1956, Ravi's interest in the tarwad property will not be distributed according to the traditional marumakkattayam law. Instead, it will be distributed according to the rules of intestate or testamentary succession as laid out in the Hindu Succession Act.

For example, if Ravi had a wife and two children, his share of the tarwad property would be divided among them as per the Act, irrespective of whether he had the right to demand a partition under the marumakkattayam law. If Ravi had left a will, the property would be distributed according to his wishes, as stated in the will, which is testamentary succession.
