Imagine a situation where a Hindu man, who has not left a will, passes away. He is survived by his wife, two sons, one daughter, and his mother. He also has one pre-deceased son who is survived by his wife and two children.

In accordance with Section 10 of The Hindu Succession Act, 1956, the property of this man (the intestate) will be divided as follows:

  • The widow of the intestate will receive one share of the property.
  • Each of the two surviving sons and the daughter will also receive one share each.
  • The mother of the intestate will receive one share as well.
  • The share of the pre-deceased son will be divided amongst his own heirs: his widow will receive a portion, and his two children will receive equal portions of that share.

Therefore, the property will be divided into five equal shares, with the widow, two surviving sons, daughter, and mother each receiving one share, and the share of the pre-deceased son being distributed among his widow and children.
