Imagine a scenario where a Hindu man passes away, leaving behind his widow. Under the original provisions of the Hindu Succession Act, 1956, the widow would be one of the heirs to his estate. However, if she chose to remarry, Section 24 of the Act, before it was omitted, would have prevented her from inheriting as a widow after her remarriage.
But since this section has been omitted effective from September 9, 2005, by the Hindu Succession (Amendment) Act, 2005, in a current scenario, even if the widow remarries, she would not lose her right to inherit her deceased husband's property. This amendment reflects a change towards gender equality and the empowerment of women.
