Explanation using Example
Imagine a situation where a Hindu man dies without leaving a will (intestate). He has three children: two sons and one daughter. According to Section 19 of The Hindu Succession Act, 1956, each child is entitled to an equal share of the man's property. This means they inherit the property per capita, that is, by individual shares, rather than per stirpes, where the share would be divided according to the branches of the family.
Additionally, the children will hold the property as tenants-in-common, meaning each has an individual share that they can dispose of as they wish, and upon their death, their share will pass to their heirs, not to the other surviving siblings.
