Imagine a scenario where a Hindu woman named Priya, who is governed by the Mitakshara law, passes away without leaving a will. She is survived by her husband, a son, and a daughter. Under the provisions of Section 29-A of the Hindu Succession (Tamil Nadu Amendment) Act, 1989, her daughter is entitled to an equal share in the coparcenary property, just as her son would be.
At the time of partition of the property, the property must be divided equally between the son and the daughter, ensuring that the daughter receives the same share as the son. This amendment empowers the daughter to have equal rights in the ancestral property, which was not recognized before the amendment in Tamil Nadu.
