Explanation using Example
Imagine a Hindu couple, Ravi and Priya, who got married in 1954. Ravi and Priya belong to the same gotra, which traditionally could be a barrier to marriage within the Hindu community. However, after the Hindu Marriage Act of 1955 came into effect, their marriage remains valid under Section 29(1) despite the same gotra because the Act recognizes their union as legally binding.
In another scenario, let's say Meena, who married under Hindu customs in 1952, wants to dissolve her marriage due to certain issues. There exists a customary law in her community that allows for dissolution of marriage under specific conditions. Section 29(2) ensures that Meena's right to seek a divorce based on her community's customs is not impacted by the Hindu Marriage Act, 1955.
