Explanation using Example

Imagine a scenario where Rita and Arjun are a married couple. After five years of marriage, Rita discovers that Arjun has been having an affair with another woman and has engaged in voluntary sexual intercourse with her. Feeling betrayed and unable to trust Arjun, Rita decides to file for divorce.

Under Section 13(1)(i) of The Hindu Marriage Act, 1955, Rita has the legal ground to seek a divorce on the basis that Arjun has committed adultery after their marriage was solemnized. She presents her petition to the family court, and the court grants her a decree of divorce, dissolving their marriage.
