Imagine a scenario where Rita files for divorce against her husband Arun on the grounds of cruelty. During the proceedings, Arun not only defends himself against the allegations but also files a counter-claim for divorce on the grounds of Rita's adultery. If Arun is able to provide sufficient evidence of Rita's adultery, the court may grant Arun the divorce he seeks, even though he was not the one who initially filed for divorce. This application of Section 23A allows a respondent to seek their own relief in the same proceedings initiated by the petitioner.
