Explanation using Example
Imagine a garment factory in Maharashtra that operates in multiple shifts due to high demand for its products. According to Section 66 of The Factories Act, 1948, the factory is generally not allowed to have female workers on the night shift, which is between 7 P.M. and 6 A.M. However, the factory management wants to run a night shift and employ female workers due to a large order that needs to be completed quickly.
To comply with the law and yet meet their production targets, the factory management looks into the State Amendment by Maharashtra which allows women workers to be employed during night hours provided the factory has adequate safety and security measures in place. The management conducts a thorough safety audit, installs additional security systems, ensures safe transportation for female workers, and then applies for the necessary permissions from the State Government.
Once the government is satisfied with the safety measures and grants the exemption, the factory can legally employ women during the night shift, ensuring that the large order is completed on time without violating the provisions of The Factories Act, 1948.
