Explanation using Example
Imagine a factory worker named Arjun sustains an injury while operating machinery. Under the Employees Compensation Act, 1923, Arjun is entitled to compensation for his injury. To process his claim, the State Government has appointed a Commissioner for Workmen's Compensation, Mr. Sharma, who has over five years of experience as a member of the State Judicial Service. Mr. Sharma's jurisdiction covers the area where the factory is located.
Since there are several cases of worker's compensation in the same area, the State Government has appointed another Commissioner, Ms. Gupta, to handle the workload. The government issues a special order detailing which types of cases will be handled by Mr. Sharma and which by Ms. Gupta to ensure efficient processing of all claims.
In Arjun's case, Mr. Sharma, while deciding on the compensation amount, may require the assistance of a medical expert to understand the extent of Arjun's injury. He can choose this medical expert to assist him during the inquiry, as per the provisions of the Act.
Throughout the process, Mr. Sharma is required to carry out his duties with the integrity expected of a public servant, as he is deemed to be one under the Indian Penal Code.
