Explanation using Example
Imagine a scenario where an employee named Rohit, who works as a mechanic for a transport company, suffers an injury while repairing a vehicle. The injury causes him to be partially disabled, affecting his ability to perform certain tasks at work.
Rohit's employer is required to compensate him for his injury under the Employees Compensation Act, 1923. Since Rohit is an "employee" as defined in section 2(dd)(ii)(c) of the Act, he is entitled to compensation for his partial disablement as per section 2(g).
After the accident, Rohit's employer contacts the "Commissioner for Workmen's Compensation" as mentioned in section 2(b), to report the injury and begin the compensation process. The Commissioner evaluates the degree of Rohit's disablement and calculates the compensation amount in accordance with the Act.
Unfortunately, Rohit passes away due to complications from the injury. In this case, his "dependants" as defined in section 2(d), such as his widow and minor children, become eligible to claim compensation for his death.
The employer's "managing agent" (section 2(f)) may handle the compensation claim on behalf of the company, ensuring that Rohit's family receives the financial support they are entitled to under the Act.
