Explanation using Example
Imagine you have purchased a luxury car worth INR 1.5 crores and encountered several issues with its engine within a few months of purchase. Despite multiple service attempts, the car dealership is unable to fix the problem. You decide to file a complaint seeking a refund or a replacement car.
In this scenario, since the value of the car exceeds INR 1 crore but is less than INR 10 crore, your complaint would fall under the jurisdiction of the State Commission as per Section 47(1)(a)(i) of the Consumer Protection Act, 2019. If you're dissatisfied with the decision of the District Commission on this matter, you can appeal to the State Commission under Section 47(1)(a)(iii).
If there is a dispute within the State Commission regarding the decision for your case, the majority's opinion will prevail as per Section 47(3). Should the members be equally divided, the matter will be referred to the President of the State Commission for a final decision.
Furthermore, you have the option to file the complaint in the State Commission located in the jurisdiction where you reside, where the car dealership has its business or branch office, or where the cause of action arose, according to Section 47(4).
