Explanation using Example
Imagine a scenario where Mrs. Sharma, a resident of Jaipur, purchases a refrigerator from a local electronics store. After a month, the refrigerator stops working, and despite multiple complaints, the store and the manufacturer fail to address her issue. Mrs. Sharma decides to seek redressal for her consumer grievance.
Under Section 42 of the Consumer Protection Act, 2019, Mrs. Sharma can approach the Rajasthan State Consumer Disputes Redressal Commission, commonly referred to as the State Commission, which is established by the State Government of Rajasthan in Jaipur, the state capital.
The State Commission is empowered to hear complaints about defects in goods and deficiencies in services. Mrs. Sharma can file her complaint with the State Commission if her claim exceeds the financial jurisdiction of the District Commission, or if she is not satisfied with the order of the District Commission and wishes to appeal against it.
Thanks to Section 42 of the Act, consumers like Mrs. Sharma have access to a State-level commission that can address their grievances and provide justice in disputes with manufacturers and sellers.
