Explanation using Example
Imagine the Board of Governors of the Central Agricultural University is scheduled to meet to approve the budget for the upcoming academic year. There are supposed to be 12 members on the Board, but due to a recent resignation, there are only 11 members at the time of the meeting. Despite this vacancy, the Board goes ahead and holds the meeting, during which the budget is approved with a majority vote.
Later, a dispute arises with a claim that the budget approval should be invalid because there was a vacancy on the Board. However, according to Section 38 of The Central Agricultural University Act, 1992, the act of approving the budget is not invalidated by the mere existence of a vacancy. Therefore, the budget approval remains valid and the University can continue its financial planning for the year.
