Explanation using Example

Imagine a farmer, Mr. Sharma, who grows apples in his orchard. He decides to sell his produce under the impression that they meet the criteria for a 'Grade A' quality mark. However, he doesn't actually get his apples graded by the authorized agency and falsely labels them as 'Grade A' before selling them to a distributor. This act of selling apples with a false grade is known as selling a 'migraded' article.

If caught, Mr. Sharma would be in violation of Section 5A of The Agricultural Produce (Grading and Marking) Act, 1937. As a result, he could face a penalty, which might include imprisonment for up to six months, a fine up to five thousand rupees, or both, for misleading consumers and distributors by falsely representing the quality of his produce.
