Explanation using Example

Imagine an organization named "Green Earth Movement" which has been included in the First Schedule of the Unlawful Activities (Prevention) Act as a terrorist organization due to some of its members' involvement in unlawful activities. The organization claims that it is primarily an environmental advocacy group and that the actions of a few do not represent the organization's objectives. To clear its name, "Green Earth Movement" applies to the Central Government under Section 36(1) of the Act, requesting to be removed from the list of terrorist organizations.

Additionally, a member of the organization, whose name has been included in the Fourth Schedule as a terrorist, also applies under Section 36(1), claiming he was wrongly associated with the unlawful activities and provides evidence that he was not involved.

If the Central Government rejects their applications, they have the right to apply for a review to the Review Committee under Section 36(4) within one month of receiving the order of refusal. Should the Review Committee find that the original decision was flawed, it can order the removal of the organization or individual from the respective Schedules under Section 36(6), compelling the Central Government to act accordingly under Section 36(7).
