Explanation using Example

Imagine a situation where an individual, Mr. X, is on trial for funding a terrorist organization, which is an offence under Chapter IV of The Unlawful Activities (Prevention) Act, 1967. During the trial, the court decides to take preventive action to ensure that Mr. X cannot transfer or hide his assets. Based on Section 33(1), the court orders that all of Mr. X's properties, including his house and bank accounts, be attached for the duration of the trial.

Following the trial, Mr. X is found guilty of the offence. The court then invokes Section 33(2) and issues a written order declaring that Mr. X's assets, such as his luxury car and commercial real estate, are to be forfeited to the government, ensuring that the proceeds from these assets do not benefit him or further any unlawful activities.

In another scenario, if Mr. X had been involved in the circulation of high quality counterfeit currency, the court, using Section 33(3), may order the attachment or forfeiture of assets equivalent to the value of the counterfeit currency seized, to offset the economic impact of the crime.

If Mr. X had been involved in a case where the proceeds of terrorism were a factor, under Section 33(4), the court could order the attachment or forfeiture of assets that are equivalent in value to those proceeds, thereby disrupting the financial support for terrorist activities.

Lastly, if Mr. X dies or flees during the trial, making it impossible to conclude the proceedings, Section 33(5) allows the court to confiscate his property based on the evidence presented, ensuring that the assets do not remain in the hands of those who might continue his unlawful activities.
