Explanation using Example
Imagine a scenario where the National Investigation Agency (NIA) is investigating a suspected terrorism financing network. During the investigation, they identify a house in a state that they believe was purchased with funds obtained through terrorist activities. The officer in charge, with the written approval of the Director General of the NIA, issues an order to seize the property to prevent any transactions involving this house.
Following the seizure, the officer informs the Designated Authority about the action taken within the stipulated forty-eight-hour period. The owner of the house is given an opportunity to make a representation to the Designated Authority, who has sixty days to confirm or revoke the seizure order. If the Authority confirms the seizure, the owner of the house may appeal this decision in court within thirty days.
In a related incident, the investigating officer finds a person carrying a large sum of cash. Suspecting that it is meant for terrorist activities, the officer seizes the cash. If the cash is not related to the ongoing investigation, it must be released within forty-eight hours unless the Designated Authority orders its retention.
