Explanation using Example

Imagine that Rita has a financial claim against a company for unpaid consultancy fees. She decides to transfer this claim to her friend, Arjun, because she is moving abroad and won't be able to pursue the collection of the debt. According to Section 131 of The Transfer of Property Act, 1882, Rita must provide a written notice of this transfer to the company. The notice must be signed by Rita or her authorized agent. It should clearly state Arjun's name and address as the new claimant. If Rita refuses to sign the notice for some reason, then Arjun or his agent can sign the notice instead. This ensures that the company is formally informed of the new party to whom the debt is owed and can proceed with payment to the correct individual.
