Imagine John has rented an apartment from Mary for a period of one year, according to a written lease agreement. Here's how Section 111 of The Transfer of Property Act, 1882 might apply in different scenarios:

  • If the one-year lease period comes to an end and is not renewed, the lease determines by efflux of the time limited thereby (clause 1).
  • If the lease states that John must not keep pets and John adopts a dog, Mary can choose to end the lease by forfeiture for breaking an express condition (clause 7a).
  • If John wins the lottery and decides to buy the apartment from Mary, and they both agree, the lease determines by express surrender as John no longer needs to rent (clause 5).
  • Suppose John's company transfers him to another city and he has to move out. He and Mary agree that he will vacate before the lease ends. This mutual agreement can lead to the lease ending by implied surrender (clause 6).
  • If Mary sends a written notice to John stating that she needs the apartment back in two months, and John acknowledges this notice, the lease would determine on the expiration of a notice to quit given by Mary (clause 8).
