Explanation using Example
Imagine a person named Ravi who lives in Mumbai, India, and wants to sell his apartment to another person, Priya. The Transfer of Property Act, 1882, would govern this transaction.
Since Mumbai was part of the State of Bombay mentioned in the Act, originally the Act did not automatically apply there. However, after the reorganization of states and subsequent government notifications, the Act now fully applies in Mumbai.
When Ravi sells his apartment to Priya, they must follow the provisions of the Transfer of Property Act, 1882, particularly those relating to the sale of immovable property (Section 54) and the compulsory registration of the sale deed (Section 59).
If, for some reason, the State Government of Maharashtra decided that in some part of the state, the aforementioned sections should not apply, it has the power to issue a notification in the Official Gazette to exempt that part from these provisions.
