Explanation using Example

Imagine a situation where Mr. John Doe is the registered proprietor of a well-known trade mark "Doe's Delights". However, due to an administrative error, his name was entered as "John Deo" in the trade mark registry. According to Section 58(1)(a) of The Trade Marks Act, 1999, Mr. Doe can apply to the Registrar to correct this error in his name.

In another scenario, Mr. Doe decides to move his business from New York to Los Angeles. He can apply to the Registrar to change his registered address as per Section 58(1)(b).

If Mr. Doe decides to discontinue his business, he can request the Registrar to cancel the entry of his trade mark from the register as per Section 58(1)(c).

Suppose Mr. Doe initially registered his trade mark for both confectionery and beverages, but later decides to focus only on confectionery. He can request the Registrar to strike out 'beverages' from the goods for which his trade mark is registered, as per Section 58(1)(d).

Lastly, if a registered user of "Doe's Delights" trade mark, say a franchisee, moves his outlet to a different location, he can apply to the Registrar to change his registered address as per Section 58(2).
