Explanation using Example

Imagine that Tezpur University has just been established under the Tezpur University Act, 1993. In accordance with Section 43 of the Act:

  • The President of India, who is the Visitor of the university, appoints Mr. A as the first Vice-Chancellor. Mr. A will serve a fixed term of five years, regardless of the usual selection process outlined in the Act and Statutes.
  • Similarly, the Visitor appoints Ms. B as the first Registrar and Mr. C as the first Finance Officer. Both Ms. B and Mr. C will have a tenure of three years in their respective positions.
  • For the initial management of the university, the Visitor nominates 11 distinguished individuals to form the first Board of Management. These members are tasked with governing the university for three years.
  • Since the university is new, it will take some time to establish its own Academic Council and Planning Board. Therefore, for the first ten years, a Planning and Academic Committee, which was constituted under section 20 of the Act, will perform their functions. This is a temporary arrangement to ensure the university's academic and strategic planning is not hindered.
  • If, for example, one of the nominated Board members resigns after one year, the Visitor will nominate a replacement who will only serve for the remaining two years of the original term, rather than a full three-year term.
