Explanation using Example
Imagine the Telecom Regulatory Authority of India (TRAI) is planning to introduce new regulations to manage the increasing number of telecom disputes related to billing and fair usage policies. To handle these disputes effectively, TRAI decides to set up a dedicated dispute resolution team. According to Section 10(1) of the TRAI Act, 1997, TRAI has the authority to appoint new officers and employees to form this team, ensuring they have the necessary expertise to efficiently discharge their functions.
Once the team is formed, TRAI needs to decide on the salary, allowances, and other service conditions for these new appointees. As per Section 10(2) of the Act, these terms must be prescribed according to the rules set out by the Authority. If there were any previous regulations regarding the compensation of TRAI officers and employees before the 2000 amendment, they would no longer be valid upon the notification of new rules as per the proviso in Section 10(2).
