39A Enforcement of decrees and orders - All decrees and orders made by the court in any proceeding under Chapter V or Chapter VI shall be enforced in the like manner as the decrees and orders of the court made in the exercise of its original civil jurisdiction for the time being are enforced.
Simplified Act
Enforcement of Court Decisions and Orders - Any official decisions or orders from a court that come from cases under Chapter V or Chapter VI of this law will be put into action the same way as any other civil court decisions or orders are currently carried out.
Explanation using Example
Imagine a couple, John and Priya, who got married under the Special Marriage Act. After several years, they decide to get a divorce due to irreconcilable differences. They approach the court, and the court grants a decree of divorce under Chapter VI of the Special Marriage Act, which also includes an order for John to pay alimony to Priya.
In this scenario, if John does not comply with the order to pay alimony, Priya can seek enforcement of the court's decree and order. ...
