Imagine a farmer in the state of Uttar Pradesh who decides to purchase wheat seeds for the upcoming sowing season. The State Government of Uttar Pradesh, under Section 13(1) of The Seeds Act, 1966, has appointed Seed Inspectors to ensure that the seeds sold in the market meet the necessary quality standards. One of these inspectors, with the proper qualifications, is assigned to the area where the farmer's land is located.
The farmer buys the seeds from a local vendor and plants them. However, the seeds fail to germinate properly, leading to a poor crop yield. Suspecting that the seeds may have been of substandard quality, the farmer contacts the Seed Inspector for the region. Acting under the authority given by Section 13(2) of the Act, the Seed Inspector, as a public servant, investigates the complaint. He collects samples from the vendor, sends them for testing, and discovers that the seeds sold were indeed below the prescribed quality standards. The Seed Inspector then takes appropriate legal action against the vendor to address the violation of the Act.
