Explanation using Example
Imagine there is a person named John who has been found guilty of committing an atrocity against a member of the Scheduled Castes community. The Special Court, under Section 10 of The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, orders John to leave the area where the crime took place to prevent further harm or intimidation to the community.
If John disregards this order and either fails to leave the area or leaves but then re-enters the area without written permission from the Special Court, he would be in violation of Section 11(1). As a result, the Special Court has the authority to have John arrested and removed from the area in police custody.
However, if John has a valid reason to return to the area, such as to attend a family funeral, he can request temporary permission from the Special Court under Section 11(2). The court may allow this, subject to certain conditions, and might require John to sign a bond ensuring that he will follow these conditions.
Should the Special Court decide that the temporary permission is no longer warranted, it can revoke this permission at any time as per Section 11(3). John must then immediately comply with the original order to stay out of the area.
Lastly, if John violates any of the conditions set by the court or fails to leave after the temporary period has expired, or if the permission is revoked and he still enters the area, he would again be subject to arrest and removal as per Section 11(5).
