Imagine a scenario where the state government initiates the process of acquiring land for a new highway project. Notices are sent out to landowners, and preliminary surveys are conducted. However, before possession of the land is taken, the government decides to alter the route of the highway due to the discovery of an endangered species' habitat along the initially planned route.

As a result, the government no longer requires Mr. Sharma's land, which was initially marked for acquisition. Under Section 93(1) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the government is at liberty to withdraw from acquiring Mr. Sharma's land since they have not yet taken possession of it.

Following this, as per Section 93(2), the Collector is responsible for determining the compensation for Mr. Sharma for any damage or loss he may have incurred due to the acquisition proceedings, such as legal costs or the impact on the value of his land during the period when it was under potential acquisition. The Collector then ensures that Mr. Sharma is paid this compensation along with any reasonable costs he might have incurred while the land acquisition process was in progress.
