Explanation using Example
Imagine a scenario where the government decides to acquire land for a new highway project. Mr. Sharma owns a piece of land that is identified for acquisition. The Collector, after assessing the land, offers Mr. Sharma compensation which he feels is inadequate. Mr. Sharma is also concerned that the Collector has not properly addressed his entitlement to resettlement benefits.
Under Section 64 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, Mr. Sharma has the right to challenge the Collector's decision. He submits a written application to the Collector within six weeks of the award, as he was present during the award decision. In his application, he specifies his objections to the compensation amount and the lack of proper resettlement benefits.
The Collector is required to refer this matter to the appropriate Authority within thirty days of receiving Mr. Sharma's application. If the Collector fails to do so, Mr. Sharma can directly approach the Authority to request that they instruct the Collector to make the referral.
